Hernandez supposedly told TNA that his contract with LU was done and he was free to sign with them He may have, but that does not excuse TNA from doing its due diligence and verifying that he was indeed free to sign. TNA was taught a very expensive lesson. WCW got real close to being pinched with this in dealing with Sabu. WCW was not able to verify Sabu was free to sign with them, and did not sign Sabu.

WCW wasn't able to verify Sabu because Paul E. wasn't answering his phone for fear of it being debt collectors. Regardless, TNA was wrong from not doing their due diligence, Hernandez was in the wrong for saying he was in the clear when he wasn't (and frankly TNA should sue him, as he entered into an agreement with them under false pretenses.), and Lucha Underground, though not in the wrong, probably should have taken pity on TNA and let them use the existing footage in exchange for a fee.

I guess TNA offered to pay LU, but LU declined. Perhaps the framed piece of table that Bully Rays butt went through when power bombing Dixie was not enough of an offer. Lol.
