Kinda sounds like it is a grey area that isn't directly addressed in law. As an employer it actually isn't smart to do this because you just open yourself up to lawsuits. Lets say you log into someones profile and see that they have a kid or are married. Those are questions that you aren't allowed to ask when hiring. Someone could come back and say "They didn't hire me because I am a single mom" or whatever. You are just asking for lawsuits.

I don't have as much of a problem with this as long as employers are held to the same standards.
